[2025:RJ-JP:4605] (2 of 2) [CRLAS-3352/2024] witness of recovery has not supported the story of prosecution.
Learned counsel also submits that co-accused Babulal and Gopiram have been enlarged on bail by the Co-ordinate Bench of this Court. Conclusion of the trial will take time. So, the appellant be enlarged on bail.
3. Learned Dy.G.A. has opposed the arguments advanced by counsel for the appellant and submitted that appellant and other co-accused had committed dacoity and murdered the complainant’s wife Surta Devi. On the basis of information, gold, silver articles and cash of Rs. 8,60,000/- were recovered from the possession of the appellant. Out of 24 witnesses, statements of 14 witnesses have been recorded by the trial Court and the trial is likely to be concluded very soon. So, the appeal be dismissed.
4. I have considered the arguments advanced by counsel for the appellant as well learned Dy.G.A.
5. Appellant and other co-accused had committed dacoity and murdered the complainant’s wife- Surta Devi. On the basis of information, gold, silver articles and cash of Rs. 8,60,000/- were recovered from the possession of the appellant. Statements of 14 witnesses have been recorded by the trial Court. Thus, trial is going to be concluded very soon. So, looking to the gravity of offence and nature of allegations levelled against the accused appellant, I do not consider it a fit case to enlarge the appellant on bail.
6. Hence, the criminal appeal stands dismissed.
