learned counsel for the petitioners and respondent No.2 as well as learned High Court Government Pleader for respondent No.1/State are present. 2. Petitioner Nos.1 to 4/accused Nos.1 to 4 and respondent No.2/complainant are present. 3. A joint affidavit in the form of a compromise petition is filed. The terms of the affidavit, which reads as under:
" We, (1) A.S. Aniruddha S/o Subrahmanya Aithal, aged about 33 years, residing at No.A- 01/1103, Sandeep Vihar AWHO, Kadugodi, Kannamangala, Bengaluru - 560067; (2) Subrahmanya Aithal, S/o. Late Narasimha Aithal, Aged About 62 years, residing at No.A-01/1103, Sandeep Vihar AWHO, Kadugodi, Kannamangala, Bengaluru - 560067 (3) Vasudha Aithal, W/o. Mr. Subrahmanya Aithal, Aged about 57 years, residing at No.A-01/1103, Sandeep Vihar AWHO, Kadugodi, Kannamangala, Bengaluru - 560067; (4) Β. Radhakant Tantri, S/o. Late B.Venkatakrishna Tantri, Aged about 52 years, residing at No.5F- 801, Provident Sunworth Apartment, Venkatapura Village, Kengeri Hobli, Mysuru Road, Bengaluru 560060; the Petitioners in the above matter and the Respondent No.2 namely Mrs.Samana K., D/o. Krishnamurthy Holla, Aged about 27 years,

Residing at No.237, Krishnaiah Road, K.R. Mohalla, Mysuru- 570024; do hereby solemnly affirm and state as follows:
1. I, the Respondent No.2 hereinabove state that I have lodged a Complaint against the Petitioners on 29.10.2022 and the same was registered by the Respondent No.1 vide Crime No.147/2022, for which the charge sheet was also filed by the First Respondent Police upon which the Hon'ble VII ASCJ & JMFC, Mysuru; by its impugned order dated 26.08.2023 in C.C.No.258/2023 took cognizance of the offences punishable under Sections 498-A r/w Section 34 of the Indian Penal Code, 1860; and Sections 3 and 4 of Dowry Prohibition Act, 1961; against the Petitioners 1 to 4 hereinabove. 2. We the Petitioner No.1 and the Respondent No.2 herein state that the dispute in question has been settled/compromised between both of us in M.C.No.1205/2024 before the learned Principal Judge, Family Court, Mysuru; on 06.06.2025. 3. We state that the Petitioner No. 1 and the Respondent No. 2 herein have settled the matter before the learned Principal Judge, Family Court, Mysuru; on 06.06.2025 and have entered into a settlement agreement to amicably settle the matrimonial disputes between all the Petitioners and the Respondent No.2. 4.
We state that it is undertaken by the Petitioner No.1 and the Respondent No.2 in the compromise petition filed by them in M.C.No.1205/2024 under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 before the learned Principal Judge, Family Court, Mysuru; that they would cooperate with each other to amicably settle and close all the legal disputes pending between them. 5. We state that the terms of compromise in M.C.No.1205/2024 between the Petitioner No.1 and Respondent No.2 are as follows:

a. It is mutually agreed between the parties that the Petitioner No.1 will pay a one-time lump sum amount of Rs.4,00,000/- (Rupees Four Lakhs Only) as full and final settlement towards permanent alimony and other claims of Respondent No.2. The Respondent No.2 has agreed to accept the sum of Rs.4,00,000/- (Rupees Four Lakhs Only) as full and final settlement towards all her claims from the Petitioner No.1 including maintenance and permanent alimony, past, present and future without any undue influence or coercion. b. The Petitioner No.1 has produced a Demand Draft bearing No.716701 dated 03.06.2025 drawn on State Bank of India, Sandeep Vihar AHWO Branch, Bengaluru and another Demand Draft bearing No.716702 dated 03.06.2025 also drawn on the aforesaid bank branch, each for a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) and together amounting to Rs.4,00,000/- (Rupees Four Lakhs Only) in the favour of Respondent No.2. The D.D. bearing No.716701 dated 03.06.2025 was handed over to the Respondent No.2 on
06.06.2025. The Respondent No.2 received and accepted the said D.D. on 06.06.2025. The other D.D. bearing No.716702 dated 03.06.2025 for Rs.2,00,000/- (Rupees Two Lakhs Only) would be handed over by the Petitioner No.1 to the Respondent No.2 on her appearance before the Hon'ble High Court of Karnataka, in Crl.Pet.No.12141/2023 towards closure/quashing of the criminal proceedings and in W.P.No.15775/2024 towards closure of Crl.Misc.No.958/2022 under Section 125 of Cr.P.C. whichever being subsequest.
c. Both the Petitioner No.1 and the Respondent No.2 admit and agree that they have exchanged all their belongings including all their respective jewellery items and there are no claims whatsoever against each other in this regard. d. Apart from the above mentioned lump sum amount, the Respondent No.2 has no other claims whatsoever as against the Petitioner No.1 or his

family members and she has no claims in the assets, movable and immovable properties, if any, that the Petitioner No.1 may inherit or acquire in his name. Similarly, the Petitioner No.1 has no claims whatsoever against the Respondent No.2 either in the movable or immovable properties that are in her name or which she may acquire or inherit. e. The Respondent No.2 has agreed and undertaken that she will extend all assistance and cooperation in having the criminal proceedings in C.C.No.258/2023 and the maintenance proceedings in Crl.Misc.No.958/2022 disposed of as withdrawn in terms of the compromise petition agreement. The Respondent No.2 has agreed and undertaken that she will be personally present before the Hon'ble High Court of Karnataka or the trial court as the case maybe as and when the proceedings in Crl.Pet.No.12141/2023 and W.P.No.15775/2024 or C.C.No.258/2023 and Crl.Misc.No.958/2022 respectively are scheduled for hearing. f. Both the Petitioner and the Respondent No.2 have admitted and agreed upon that they will not interfere with the personal and professional life of each other or file any civil or criminal cases against each other or their families. 6. We state that the compromise between the Respondent No.2 and the Petitioners has been arrived with their free consent, without any threat or coercion or undue influence. 7.
I, Smt. Samana K. I.e., the Respondent No.2 hereinabove state that I am not desirous of pursuing the matter arising out of my Complaint dated 29.10.2022 registered by the Respondent No.1 police vide Crime No.147/2022, for which the charge sheet was also filed by the First Respondent Police upon which the Hon'ble VII ASCJ & JMFC, Mysuru; by its impugned order dated 26.08.2023 in C.C.No.258/2023 took cognizance of the offences punishable under Sections 498-A r/w Section 34 of the Indian Penal Code, 1860; and

Sections 3 and 4 of Dowry Prohibition Act, 1961; against the Petitioners hereinabove for which the present joint affidavit is filed by both the parties. 8. I, the Respondent No.2 hereinabove state that now the dispute between me and the Petitioners are resolved and compromised and hence I have decided to withdraw all the allegations in the abovementioned complaint and as I do not intend to pursue any further proceedings against the Petitioners and hence we request this Hon'ble Court to quash the criminal proceedings in its entirety. WHEREFORE, we humbly pray before this Hon'ble Court to quash the Complaint dated 29.10.2022 registered by the Respondent No.1 police vide Crime No.147/2022, Charge sheet dated 15.07.2023 filed by 1st Respondent Police upon which the Hon'ble VII ASCJ & JMFC, Mysuru; by Its impugned
order dated 26.08.2023 in C.C.No.258/2023 took cognizance of the offences punishable under Sections 498-A r/w Section 34 of the Indian Penal Code, 1860; and Sections 3 and 4 of Dowry Prohibition Act, 1961 against the Petitioners Nos.1, 2, 3 and 4 as mentioned hereinabove."
4. Respondent No.2 admits settlement and compromise and respondent No.2 receives Demand Draft for a sum of Rs.2,00,000/- towards balance payment.
5. In the light of the compromise entered between the parties, the following order:

ORDER (i) The petition filed under Section 482 of Cr.P.C, is allowed. (ii) The criminal proceedings initiated against the petitioners/accused Nos.1 *to 4 in C.C.No.258/2023 (Crime No.147/2022) on the file of VII Additional Senior Civil Judge and JMFC, Mysuru, is hereby quashed. (iii) The Registry is directed to send copy of this order to the trial Court forthwith.
In view of disposal of petitions, pending application/s, if any, stands disposed off, as no separate
order is required.
