Criminal Appeal (Sb) No.3285/2024 Yudhishthir Singh S/o Shri Laxman Singh, Aged About 34 Years, R/o Village Tamadiya, Tehsil Chaksu, District Jaipur (Rajasthan) ----Appellant Versus 1. State Of Rajasthan, Through Public Prosecutor 2. Rakesh Kumar Meena S/o Kishan Meena, Aged About 34 Years, R/o Hanutiya Bujurg, Police Station Niwai Sadar, District Tonk. ----Respondents For Appellant(s) : Mr. Siddharth Bapna, Adv. Mr. Banwari Singh, Adv. For Respondent(s) : Mr. R.S. Shekhawat, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 20/01/2025 1. This criminal appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 18.11.2024, passed by the learned Special Judge S.C./S.T. (Prevention of Atrocities Cases), Jaipur Metropolitan (First), Jaipur (hereinafter to be referred as ‘trial court’) in Anticipatory Bail Application No.272/2024, whereby the trial court has dismissed the anticipatory bail application filed on behalf of the appellant. 2. The appellant apprehends his arrest in connection with FIR No.471/2022, registered at Police Station Chaksu, District Jaipur (South), for the offences punishable under Sections 143, 323, [2025:RJ-JP:2705] (2 of 3) [CRLAS-3285/2024] 341, 427 and 379 of IPC and Sections 3(1)(r), 3(1)(s) and 3(2) (va) of SC/ST Act. 3. Learned counsel for the appellant submits that the appellant has falsely been implicated in this case. It is contended that the injuries sustained to the injured Rakesh Kumar Meena are simple blunt in nature and the other co-accused named in the FIR have already been enlarged on regular bail by the learned trial Court itself. The allegations levelled against the appellant are not specific rather omnibus in nature. The appellant is ready and willing to co- operate with the investigation, custodial interrogation of the appellant is not required, therefore, the appeal of the accused- appellant may be allowed. 4. Learned Public Prosecutor vehemently opposed the appeal. It is contended that it is alleged against the appellant that he alongwith the other co-accused insulted the complainant by abusing him and thereafter, caused injury to the complainant, therefore, the appeal of the accused-appellant may be dismissed. 5. Heard and perused the material available on the record. 6. Considering the fact that the injuries sustained to injured Rakesh Kumar meena are found to be simple blunt in nature and the other co-accused have already been enlarged on regular bail by the learned trial Court, custodial interrogation of the appellant is not required and the accused-appellant is ready and willing to co-operate with the investigation, without further expressing anything on the merits of the case, I deem it just and proper to [2025:RJ-JP:2705] (3 of 3) [CRLAS-3285/2024] allow the appeal filed by the accused-appellant under Section 14- A(2) of SC/ST Act. 7.
