By way of this petition, the petitioners have sought the following relief(s):- “10.1 That this Hon’ble Court be pleased to issue an appropriate writ, order or direction, directing the Court of the Civil Judge (Junior Division), Baikunthpur, Additional Judge, District Koriya (C.G.) to expeditiously and effectively decide Misc. Civil Case No. 3/2024 (filed under Order XXXIX Rule 2A CPC) within a time-bound SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.07.16 14:22:54 +0530 2 period of three months or within such period as this Hon’ble Court may deem fit; 10.2 Any other relief, which this Hon’ble Court deems, fit in the facts and circumstances, may also be granted in favour of the petitioner.” 2. Learned counsel appearing for the petitioners would submit that an application has been moved by the petitioners under Order 39 Rule 2A of CPC bearing Miscellaneous Civil Case No. 3/2024 pending before Additional Judge to the Court of Civil Judge, Junior Division, Baikunthpur on 20.09.2024, but the same has not been decided yet. Thus, he would pray that a direction may be issued to the concerned Court to decide the pending application moved by the petitioners within a stipulated time. 3. Taking into consideration the submission made by Mr. Singh, this petition is disposed of with a direction to the concerned Court i.e. Additional Judge to the Court of Civil Judge, Junior Division, Baikunthpur, District Korea to make all endeavours to decide the application moved by the petitioners bearing Miscellaneous Civil Case No. 3/2024 expeditiously. 4.
