Ghosh, learned counsel for the respondent. Page No.# 4/5 The instant application has been filed under Order 1 Rule 10(2) read with Section 151 CPC praying for impleading the applicants as respondents in the CRP(IO) 252/2023 which is pending disposal before this Court. Learned counsel for the applicant submits that the CRP (IO)252/2023 has been filed by the petitioner/opposite party before this Court praying for setting aside and quashing the order dated 20.03.2023 passed by the learned Munsif No.1, Hailakandi. Notice was issued upon the respondent/decree holders on 09.08.2023 and thereafter on 25.04.2025 to be be served upon the remaining respondents in the connected CRP(IO)252/2023. However, the legal heirs of the deceased/decree holder No.3, namely, Lt. Rayna Begom Laskar W/ O Lt. Mosorof Ali Laskar expired on 05.07.2017 at Valley Hospital and Research Centre (P) Ltd. Meherpur, Cachar District as per death certificate dated 12.08.2017. It is also submitted that the name of the applicant herein have already been recorded as legal heir of the deceased decree holder No.3 in the Title Execution Case No. 7/2015 as per order dated 06.03.2019. In the above, facts and circumstances, the leaned counsel for the applicant prays that the instant application may be allowed and the applicants herein may be impleaded as legal heirs after the deceased decree holder No.2 as respondent in CRP(IO) 252/2023. Learned counsel for the respondent has no objection. Accordingly, the petitioner shall implead the applicants as respondents in CRP(IO) 252/2025 and thereafter file amended cause title Page No.# 5/5 within one week from today.
