[2025:RJ-JP:12252] (2 of 4) [CRLAS-138/2025] BNS and Sections 3(1)(r) & 3(1)(s) of SC/ST (Prevention of Atrocities) Amendment Act, 2018.
2. It is contended by learned counsel for the appellant that appellant has falsely been implicated in this case. Counsel submits that none of the injuries sustained to injured person has been opined as dangerous to life. It is submitted that according to the medical report, both grievous injuries have been found on non- vital part of the body. Charge-sheet has been filed and trial will take considerable time in its conclusion. Appellant is in custody since 04.01.2025 and there are no criminal antecedents against him. Further custody of the appellant would not serve any fruitful purpose.
3. Per contra, learned Public Prosecutor assisted by learned counsel for complainant vehemently opposes the prayer of bail made in this appeal. They submit that there is serious allegation against the appellant that he caused four injuries on the person of the injured out of which two injuries are opined as grievous in nature.
4. Heard learned counsel for the appellant and learned Public Prosecutor. Perused the material available on record.
5. Having regard to the totality of the facts and circumstances; considering the arguments advanced by learned counsel for both the parties, so also considering the nature of injuries; trial will take considerable time in its conclusion; absence of criminal antecedents as well as looking to the custody period, but without expressing any opinion on merits/demerits of this case, this Court deems it just and proper to enlarge the appellant on bail.
