Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 20/01/2025 1) By way of this petition, petitioner has sought following relief(s):- (i) That, this Hon'ble Court may kindly be pleased to direct the respondent No.1 to enquire and produce a report before this Hon'ble Court, as to who has constructed the existing road and nali (drainage). (ii) That, this Hon'ble Court may kindly be pleased to direct the respondent No.1 to submit a report about the action taken against the respondent No.8 colonizer on his lapse of not developing the colony even after lapse of 15 years. (iii) That, this Hon'ble Court may kindly be pleased to direct the respondent No.8 to immediately do the development work of park, laying the pipe line and construction of gate. This Hon'ble Court may kindly be pleased to direct the respondent No.1 to do the work of developing the park, laying the pipe line and construction of gate and recover the expenditure from the colonizer. (iv) That, this Hon'ble Court may kindly be pleased to direct the respondent No.1 to initiate action against the respondent No.8. (v) That, this Hon'ble Court may kindly be pleased to direct the respondent No.8 to suitably compensate the residents of the colony by paying a compensation of Rs.1,00,000/- (one lac) to 3 each residents for depriving them from enjoying the facilities of park and water supply, etc. and for facing troubles and inconveniences. (vi) That, this Hon'ble Court may be pleased to pass any other relief that this Hon'ble Court may please deem fit and proper. 2) Petitioner has sought a direction to respondent No. 1 to take action against the respondent No. 8/ colonizer on account of delay in developing the colony even after lapse of 15 years. 3) As there is no representation on behalf of petitioner, even when the matter is taken up for hearing in second round, this Court is left with no other option except to dismiss this petition. 4) Consequently, this petition stands dismissed on this count alone.
