2. A case has been registered against the petitioner herein and others for the offences punishable under sections 109(1), /.
329(4),74, 324(6) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled castes and the scheduled Tribes (Prevention of Atrocities) Act. 3. Caseoftheprosecution, in brief, is that, on 31.10.2024, at about 09.30 PM, while the de facfo complainant and her younger son and her sister's son were celebrating Deepavali festival by firing crackers, six members came in a Car and motor cycle and beat her chI'Idren indiscriminately. They also pulled them inside -+ ?fy the house and beat them with rods and tried to kill them. One -`\ > David caught hold her neck and beat her and they all abused her in filthy language by touching her caste name. Later, when they are going to their flat, about 15 to 20 members trespassed into her house with deadly weapons and pushed her by touching her breast and damaged her house. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that all the accusations are attributed against other accused. The only accusation attributed against the petitioner herein is that he was asked to drive the car and he carried out the job in taking the E= i= -I
accused to the house of the de facfo complainant. A quarrel ensued between the accused and the de facfo complainant on the ground that some of the crackers were directed to the house of the accused. ln connection with that, on the date of alleged incident, all the accused went in a Car to the house of the de facto complainant and beat her. No specific act has been attributed against the petitioner here'ln, except stating that he drove the car along with other accused. 6. ln view of the aforesaid facts and Circumstances Of the case, this court is inclined to grant anticipatory bail to the petitioner herein/Accused on the following conditions.
i) ln the event of arrest of the petitioner herein/Accused in the aforesaid crime, he shall be enlarged on bail On his executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two Sureties Of the like sum each to the I I,tD. satisfaction of the concerned Arresting Officer. ii) petitioner shall make h-ImSelf available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat Or Promise tO \`3, any person acquainted with the facts of the case so as to I-
