Neutral Citation No. - 2025:AHC:82514 Court No. - 4 Case :- WRIT - A No. - 4291 of 2025 Petitioner :- Krishna Kumar Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Ajeet Kumar Singh Counsel for Respondent :- Manmohan Singh,C.S.C.,J.P.N. Singh,Rameshwar Prasad Shukla Hon'ble Ajit Kumar,J. 1. Heard learned counsel for petitioner, Shri J.P.N.Singh, learned Advocate for Gaon Sabha and learned Standing Counsel. 2. Original records of minutes of the proceedings have been placed before the Court and I find the register to be bearing the resolution adopted by the Gaon Sabha on 29.01.2025 to remove the petitioner from the employment. Copy of this original resolution adopted by the Gaon Sabha is contained both in the administrative register as well as in the karwahi register that have been placed before the Court. 3. From the perusal of the instructions placed by learned Standing Counsel it transpires also that said resolution was duly adopted by the Gram Sabha. The original envelopes have been placed before the Court which bear the endorsement of the postman that the addressee refused to receive the same. Three envelopes contained the same remarks which the petitioner disputes on the ground that he had lodged some first information report against the postman and that was why he had put these remarks with mala fide intentions and thus the copy of notice remained unserved upon him. 4. These are the question of fact which can be gone into for its due verification by the competent authority who happens to be the District Magistrate. Learned Standing Counsel as well as learned counsel for Gaon Sabha could not place before the Curt any final approval accorded to the resolution of the Gaon Sabha. 5. In such above view of the matter this petition stands disposed of with the direction to the petitioner to approach the District Magistrate concerned raising all his grievances particularly the grievance relating to the non-service of notice. Petitioner shall approach the authority within a period of four weeks from today. The District Magistrate concerned upon receipt of such representation will summon the entire original records and will peruse the same himself and will then be passing final order within a further period of two months after giving full opportunity of hearing to the respective parties. 6. The original records are returned to the counsel for Gaon Sabha. Order Date :- 17.5.2025 Nadeem Digitally signed by :- NADEEM AHMAD High Court of Judicature at Allahabad
