Mr. Deepak Gupta, learned counsel, appears and waives service of notice on behalf of the respondent. 2. By virtue of present petition, a challenge has been laid to impugned order dated 16.10.2025, passed by learned Rent Controller, Shimla, on an application filed by the present petitioner. 3. From perusal of the impugned order, it is evident that feeling aggrieved by an ex parte eviction order, an application under Order 9 Rule 13 of the Civil Procedure Code along-with an application under Section 151 of the Civil 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 2025:HHC:39483 Procedure Code seeking interim protection has been filed before the Rent Controller. On both the applications, notices have been issued. Insofar as application seeking interim relief under Section 151 of the Civil Procedure Code is concerned, an ex parte interim order has been denied. 4. Since the application under Section 151 of the Civil Procedure Code is pending consideration before the learned Rent Controller, pleadings whereof are yet to be completed and the same has to be considered thereafter, I deem it appropriate not to interfere at the present stage. The application under Section 151 of the Civil Procedure Code seeking interim relief, pending consideration before the learned Rent Controller be decided subject to the convenience of the Rent Controller as expeditiously as possible. 5.
