The challenge in this petition is made to a notice, by which, the petitioner is required to vacate the possession on the ground that he is illegal occupant of it as well as the judgment dated 23.01.2023, passed in Case No.71 of 2018, State vs. Unauthorized Occupant Girish Lal, by the court of Prescribed Authority, Kirtinagar (“the case”), by it, the petitioner has been evicted from the property-in-question. The challenge is also made to the
judgment and order dated 14.06.2023, passed in Misc. Civil Appeal No.09 of 2023, Girish Lal vs. State of Uttarakhand, by the court of District Judge, Tehri Garhwal (“the appeal”), by which, the appeal has been
disposed of.

Heard learned counsel for the parties and perused the record.

At the very outset, learned counsel for the petitioner would submit that the matter is squarely covered by the judgment dated 15.10.2024, passed by this Court in Writ Petition No.2802 of 2024 (M/S), Jeet Lal vs. State of Uttarakhand and another.

Learned counsel for the respondents admits this fact.

Since, the matter is covered, instant petition is decided in terms of the judgment dated 15.10.2024, passed by this Court in Writ Petition No.2802 of 2024 (M/S), Jeet Lal vs. State of Uttarakhand and another.
