The instant writ petition has been filed by the petitioners with the following main prayers :- "(1) Issue writ, order, or direction in the nature of certiorari quashing the impugned First Information Report dated 25.05.2025 in Case Crime No. 70 of 2025 initially registered under Sections 498A, 323, 504, 506 IPC and Section 3/4 D.P. Act, Police Station Chilla, District Banda. (2) Issue a writ, order or direction in the nature of mandamus commanding the respondents not to arrest/harass the petitioners in pursuance to impugned First Information Report dated 25.05.2025 in Case Crime No. 70 of 2025 initially registered under Sections 498A, 323, 504, 506 IPC and Section 3/4 D.P. Act, Police Station Chilla, District Banda." 2. Learned counsel appearing on behalf of the parties have jointly submitted that the parties concerned have settled their disputes amicably and in compliance of the order dated 04.07.2025 before Mediation and Conciliation Centre, Allahabad High Court. It is further submitted that the parties concerned shall abide by all the terms and conditions mentioned in the said settlement agreement which is on record. As per the terms and condition of the agreement mentioned in paragraph-8 of the said agreement which is as follows: "8. अंतिरम समझौता िदनांक 28.11.2025 एवं 12.12.2025 के अनुसार वादकािरयों के बीच में िनम्निलिखत समझौता सम्पन्न हुआ हैः- क. यह िक दोनो पक्षों अपने िववाद को आपसी सहमित से पहले ही सुलझा िलया Versus Counsel for Petitioner(s) : Rajesh Kumar Singh Chauhan, Virendra Singh Parmar Counsel for Respondent(s) : Abdul Mateen, G.A. Bilal Ahmad And 5 Others .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) था एवं यह िनणर्य िलया था िक दोनो पक्ष अलग-अलग रहना चाहते हैं तथा तलाक लेना चाहते हैं इस प्रकार दोनो पक्षों ने आपसी सहमित से नोटरी तलाकनामा/इकरारनामा िदनांक 27.01.2026 तैयार िकया है िजसमे पक्षों के बीच तय हुई सारी िनयम एवं शतेर् िलिखत है। उपरोक्त नोटरी तलाकनामा/ इकरारनामा िदनांक 27.01.2026 माननीय न्यायालय के अवलोकनाथर् संलग्न है। ख. यह िक दोनों पक्षों के बीच यह समझौता हुआ था िक िबलाल अहमद ( यािचकाकतार् सं.1 पित) रु.7,00,000/- (रु. सात लाख मात्र) की रािश, िजसमें 2012/12 स्थायी गुजारा भत्ता, मेहर, इद्दत अविध, भरण-पोषण तथा अन्य िवत्तीय दावे भी शािमल है, अपनी पत्नी श्रीमती गुलनाज़ (प्रितवािदनी सं. 3) को िडमाण्ड ड्राफ्ट के जिरये अदा करेगा। ग. यह की िदनांक 28.11.2025 रु.1,00,000/- का एक िडमाण्ड ड्राफ्ट िजसकी संख्या 382481 इंिडयन बैंक द्वारा िदनांक 26.11.2025 को Gulanaz Begum (पत्नी) के नाम जारी, पित द्वारा प्रस्तुत िकया गया था िजसे आज िदनांक 30.01.2026 को श्रीमती गुलनाज़ (प्रितवािदनी सं. 3) को िदया जा रह है िजसकी प्रािप्त एवं श्रीमती गुलनाज़ (प्रितवािदनी सं.3) सुिनिश्चत करती है। घ. यह की िदनांक 12.12.2025 रु.3,00,000/- का एक िडमाण्ड ड्राफ्ट िजसकी संख्या 382485 इंिडयन बैंक द्वारा िदनांक 08.12.2025 को Gulanaz Begum (पत्नी) के नाम जारी, पित द्वारा प्रस्तुत िकया गया था िजसे आज िदनांक 30.01.2026 को श्रीमती गुलनाज (प्रितवािदनी सं. 3) को िदया जा रह है िजसकी प्रािप्त एवं श्रीमती गुलनाज़ (प्रितवािदनी सं.3) सुिनिश्चत करती है। ङ. यह की आज िदनांक 30.01.2026 को एक िडमाण्ड ड्राफ्ट, िजसकी संख्या 382977 िदनांक 12.01.2026 रु. 3,00,000/- का इंिडयन बैंक द्वारा द्वारा (Gulanaz Begum) पत्नी के नाम जारी, पित के द्वारा प्रस्तुत िकया गया है, िजसे श्रीमती गुलनाज़ (प्रितवािदनी सं. 3) को िदया जा रह है िजसकी प्रािप्त एवं श्रीमती गुलनाज़ (प्रितवािदनी सं.3) सुिनिश्चत करती है। च. यह िक उपरोक्त मुकदमों के अलावा दोनो पक्ष एक दूसरे के िवरुद्ध पंजीकृ त/ िवचाराधीन, समस्त वाद को, यिद हो, वापस लेंगे और समझौते में हुए सभी शतोर्ं को मानेंगें। छ. यह िक दोनो पक्ष एक दूसरे के िखलाफ, इस वैवािहक वाद के संन्दभर् में कोई नया वाद दायर नही करेंगे।" 3. Learned counsel for the parties further submits that since all the disputes between the parties concerned have already been settled before the Mediation and Conciliation Centre, Allahabad High Court, the impugned First Information Report dated 25.05.2025 against the petitioners deserves to be quashed. 4. Learned Additional Government Advocate appearing on behalf of the State-respondents has not disputed the facts of the settlement agreement. 5. Heard Mr. Virendra Singh Parmar, learned counsel appearing on behalf of the petitioners, learned counsel appearing on behalf of respondent no. 3 and CRLP No. 13967 of 2025 2 learned A.G.A. appearing on behalf of the State-respondents. 6. We have perused the settlement agreement dated 30.01.2026 sent by Allahabad High Court Mediation and Conciliation Centre. 7. Taking into consideration the submissions made by learned counsel appearing on behalf of the petitioners, learned A.G.A. appearing on behalf of the State-respondents, learned counsel appearing on behalf of respondent no. 3, the settlement agreement dated 30.01.2026 and the statement made by the parties concerned that they shall abide by all the terms and conditions of the said compromise deed, we have satisfied that no purpose would be served to put the petitioners on trial. 8. In view of the above-said facts as well as law laid down by the Apex Court in the judgment of Gian Singh Vs. State of Punjab & Another (2012) 10 SCC 303, we are inclined to allow this writ petition. 9. Accordingly, the present writ petition is allowed. 10. The impugned F.I.R. dated 25.05.2025 in Case Crime No. 70 of 2025 initially registered under Sections 498A, 323, 504, 506 IPC and Section 3/4 D.P.
