After arguing for some time, learned counsel for the appellant seeks to withdraw this Appeal as the judgment of acquittal has been passed by the Judicial Magistrate First Class, Bilaspur in Criminal Complaint Case PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2025.06.12 14:21:46 +0530 2 No.1468/2013 vide judgment dated 05.12.2019 against which the appellant has directly filed an acquittal appeal bearing Criminal Appeal No.10/2020 and the same was also ended in acquittal vide judgment dated 29.10.2021. He submits that recently in the matter of Celestium Financial vs. A. Gnanasekaran Etc. vide judgment dated 08.04.2025 passed in Criminal Appeal Nos. of 2025 (arising out of Special Leave Petition (Crl.) Nos. 137-139/2025) by the Hon’ble Supreme Court, it was held that the victim shall have a right to prefer an appeal against any order passed by the Court acquitting the accused and such appeal shall lie to the Court to which an appeal ordinarily lies against the order of conviction of such Court. He lastly submits that this Appeal may be disposed of reserving the liberty in favour of the appellant to file a petition in accordance with law against the acquittal order passed by the Session Court. 2. In view of the above, this Appeal stands disposed of reserving the aforesaid liberty. 3.
