The Court made the following ORDER: J~ HONIBLE SRI JUSTICE K.SURESH REDDY CRIMlNAL P QBEEBi This criminal petition, under Sections 437 and 439 Cr.P.C., is filed by the petitioners-accused Nos. 3 to 5 seeking tO release them On ba" in crime No. 33 of 2024 of Pedabayalu Police Station, Alluri Sitharama Raju District, registered for the Offence Punishable under Section 8 (c) read with section 20 (b) (ii) (C) of the Narcotic Drugs and PsychotrOPiC substances Act,1985. 2. Heard Sri Anand Kumar Kochiri, learned COunSel appearing for the petitioners-accused Nos. 3 to 5, and learned Assistant Public prosecutor appearing for the respondent-State. 3. Case of the Prosecution in brief 'lS that On 12-07-2024 at about 8 a.m., the sub Inspector of police] on credible information, along with his staff and mediators apprehended the petitioners at Kothaputtu Junction while they were transport-lng 350 K.Gs. of Ganja in a Vehicle bearing registrat'IOn No. AP 05 BS 2322. After conducting PanChanama and after seizing the contraband, the sub Inspector of police arrested the petitioners-accused Nos. 3 to 5 and remanded them tO judicial Custody. 4. Learned COunSel for the Petitioners-accused Nos. 3 to 5 submits that the petit'loners were arrested on 12-07-2024 and ever Since, they have been in judicial custody and that though statutory period of 180 2 days is over, the police have not filed charge sheet and as such, the r/ petI'tiOnerS-accused Nos. 3 to 5 are entI'tled to be released on bail. 5. on the other hand, learned Assistant publI-C Prosecutor, on instructI'OnS, confirms the factum of non-fill-ng Of Charge sheet even after expI'ry Of Statutory perI'Od. 6. In vl-ew of the above facts and circumstances of the case, this court js incII'ned to enlarge the petitI-OnerS-accused Nos. 3 to 5 on ba" with certain condl'tjons. 7. The petjtl®oners-accused Nos. 3 to 5 are, therefore, ordered to be released on bail on their executing each a personal bond for Rs.50,000/- with two suretI'eS for the like sum each to the satl'sfaction of learned Judicial I class Magistrate, paderu.
