Petitioner herein, who at present is working as JBT at Chowki Churan Education Block Nadaun, is aggrieved of order dated 28/29.10.2025, passed by Deputy Director (Elementary Education), in terms of order dated 15.10.2025, passed by this Court in CWP No. 16264 of 2025, titled as Pradeep Kumar v. State of Himachal Pradesh and Ors., whereby he has been transferred from afore station to GPS (Girls) Bijhari, Education Block Bijhari. 2. Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by learned counsel for the petitioner is that respondents while passing order dated 28/29.10.2025 (Annexure P-1) have failed to take note of the fact that
- 2 - petitioner is 40% disabled and as such, ought to have been given posting at convenient school near native place of the petitioner. 3. Pursuant to notice issued in the instant proceedings, respondent State has filed reply, perusal whereof reveals that petitioner has remained posted within the radius of 20kms for more than 30 years and now he has been transferred to school at Bijhari, which is situate on the road. Though, learned counsel for the petitioner attempted to argue that transferred station is at a distance of 65 kms from present place of posting, but that cannot be a ground to interfere with the impugned transfer order, especially when respondents have succeeded in proving that petitioner has remained posted within the radius of 20kms for more than 30 years and he has been given further posting, which is on the roadside. Mr. Rajan Kahol, learned Additional Advocate General, states that case of the petitioner in terms of directions issued by this Court in afore writ petition already stands considered. 4.
Since this court is convinced that having regard to the nature and extent of disability, respondents have given posting to the petitioner at a convenient school, there appears to be no justification to interfere with the impugned transfer order and as such, same is upheld, as such, present petition is dismissed.
