Order on Board 12.03.2025 1) The petitioner has filed this petition seeking the following relief(s):-
“10.1. That, this Hon'ble Court may kindly call for the entire record in relates to the case of the petitioner.
10.2. That, this Hon'ble Court may kindly be issued a writ or writs / order / or orders to direct the Respondent authorities concerned to decide the representation of petitioner dated 21.05.2018 and 22.05.2018 (Annexure P-1 colly) within stipulated time, in the interest of justice.
10.3. That, any other relief, this Hon'ble Court deem fit and proper may also kindly be granted to the petitioner, in the interest of justice.
10.4. An affidavit in support of this petition is filed herewith.” 2) Learned counsel appearing for the petitioner would submit that the petitioner was appointed as ‘Panchayat Karmi’ vide resolution dated 10.12.1995, at Gram Panchayat-Khaija, Block Baloda & District- Janjgir-Champa, and the petitioner joined the service on 10.12.1995. He would further submit that a criminal case for commission of offence punishable under Sections 420, 409, 467, 468, 471, 477A & 202 of the IPC was registered against the petitioner and he was arrested on 03.03.2017. He would contend that the petitioner was convicted and sentenced vide

judgment dated 30.12.2017 and an appeal was preferred against the said order and same was allowed vide order dated14.03.2018. He would contend that no departmental enquiry was conducted against the petitioner, therefore, he made representations before the respondent authorities on 21.05.2018 & 22.05.2018 for reinstatement, but till date no decision has been taken. 3) On the other hand, learned counsel appearing for the respondents would oppose the submission made by counsel for the petitioner and submit that there were serious allegations against the petitioner. They would fairly contend that no departmental enquiry was conducted against the petitioner. It is contended that the representations of the petitioner would be decided by the competent authorities strictly in accordance with law. 4) Taking into consideration the limited prayer made by learned counsel for the petitioner, this petition is disposed of with a direction to the respondents No.2 & 4 to decide the pending representations of the petitioner dated 21.05.2018 & 22.05.2018 in objective manner preferably within a period of 90 days from the date of receipt of copy of this order. 5) With the aforesaid observation and direction this petition is hereby disposed of.
