[2025:RJ-JP:2992] (2 of 3) [CRLMB-15557/2024]
Learned counsel for the petitioners submit that the accused petitioners have falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioners are triable by Magistrate. The accused-petitioners are in custody since 18.11.2024 and 19.11.2024 respectively and charge-sheet has already been produced before the concerned court. The trial of the case may take considerable time, therefore, the petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail applications and contended that both the petitioners are habitual offenders and against them several criminal cases were registered, therefore their bail applications deserves to be dismissed. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the fact that the accused-petitioners are in custody since and trial of the case will take considerable time and furthermore case of the petitioner is triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. Accordingly, the bail applications under Section 483 BNSS is allowed and it is ordered that the accused-petitioners Chaman S/o Shri Pannalal,Sharukh Khan S/o Mahboob Ali, in connection with FIR No. 350/2024 registered at Police Station Madanganj, District Ajmer shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge.
[2025:RJ-JP:2992] (3 of 3) [CRLMB-15557/2024] The accused- petitioners are also directed to mark their presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioners to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioners for cancellation of the bail before the concerned Magistrate.
