This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 314/2025, registered at Police Station Gandhinagar, Ambikapur, District Sarguja (C.G.) for the offence punishable under Sections under Section 318(4) & 319 of BNS 2023. 2. The case of the prosecution is that the present applicant along with one co-accused person namely Anuj Singh, asked the complainant to give his credentials to the accused persons so as to open a bank account in I.D.B.I. bank for receiving some money from the relatives of the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.17 11:04:15 +0530
2 accused persons for construction of their house. Complainant complying with the request help the accused persons and provided them with the essential documents and also attested his thumb impression in the thumb print scanning device which is required for opening a bank account. Further, on 21.05.2025 bank officials of the concerned bank came to the house of the complainant inquiring him about the bank account being operated in his name in which a total of rupees 1,80,00,000/- (one crore eighty lakhs rupees) transaction has taken place. On being aware of this fact, the complainant went to the bank on 22.05.2025 and closed the said accounts. A F.I.R. on the said incident was lodged by the complainant on 01.06.2025. 3. The learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in this case. He submits that the applicant/accused is a young man of age 19 years whose imprisonment may cast deteriorating effects on the mental state and mental welbeing of the applicant/accused. He further submits that on perusal of the FIR it can be deduced that no allegation of withdrawal of any sum of money from the said account of the complainant is made against the present applicant.
Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the
3 material available in the case diary, this Court, without expressing any opinion on the merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Sumit Singh Thakur, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
