They claimed promotion to the next higher post of Prosecuting Officer. Their representation was rejected by Additional Secretary, Home Department vide order dated 21.1.2016 on the ground that petitioners are not eligible for promotion as per the applicable rules. Thus feeling aggrieved by rejection of their claim for promotion, petitioners have approached this Court by filing this writ petition. (3) Learned State Counsel submits that as per Rule 5(2) of Uttarakhand Prosecuting Officers Service Rules, 2015 an Assistant Prosecuting Officer, who has put in seven years of service as such on the first date of recruitment year alone shall be eligible for promotion to the post of Prosecuting Officer. (4) Admittedly, petitioners had served only for three years at the time of making representation, therefore Additional Secretary was justified in rejecting the claim for promotion made by petitioners. Thus there is no force to the 2025:UHC:4736-DB challenge thrown to the rejection order. Writ petition thus fails and is dismissed. (Subhash Upadhyay, J.)
