Pilli Nagamma ...PETITIONER AND The State Of Andhra Pradesh and Others ...RESPONDENT(S) Counsel for the Petitioner: 1.D KRISHNA MURTHY Counsel for the Respondent(S): 1.GP FOR REVENUE 2 The Court made the following order: The present writ petition is filed questioning the action of the 4*^^ respondent in placing the lands admeasuring an extent of Ac.4.76 cents in Sy.No.87-1 and an extent of Ac.1.43 cents in Sy.No.143 of Ponnampalli Village, Mylavaram Mandal, Krishna District, under the disputed register, by marking the same in red colour in online revenue records, without issuing any notice to the petitioner. 2. It is the case of the petitioner that, she is the absolute owner and possessor of the subject lands. It is her further case that, her name was mutated in the revenue records and the 4*^^ respondent also issued pattadar passbooks in her favor. She filed an application dated 12.10.2021, requesting to mutate her in online web land records in respect of the subject properties. When the said application was not processed, she preferred a writ petition vide WP No. 13930 of 2022, before this Court and the was disposed of by order dated 06.05.2022, directing the petitioner to make appropriate application through Mee Seva/online in terms of GO.Ms.No.209, dated 14.06.2017, after complying with the requirements under Rule 5(3) of the rules framed under the Act 26 of 1971. In pursuance thereof, when she name same 3 tried to file the application through Mee Seva the same was not accepted, inasmuch as, the subject lands are placed under the disputed register by marking the same in red colour in online revenue records. It is further case of the petitioner that, before placing the subject lands under the disputed register, no notice whatsoever was issued to her. Questioning the said action of the 4**^ respondent, the present writ petition is filed. It is not in dispute that the petitioner’s name was mutated 3. into revenue records and she was also issued pattadar passbooks and title deeds. The 4*'^ respondent admittedly did not issue any notice before placing the subject lands under disputed register. The said action of the 4“^ respondent is nothing but violation of principles of natural justice. It is needless to mention that, whenever an action is to be initiated, the same has to be done by following the procedure contemplated under law. In the instant case, the 4''^ respondent for the reasons best know to him did not choose to issue notice to the petitioner. 4. In view of the same, the present writ petition is disposed of, directing the 4‘^ respondent to delete the subject lands from the disputed register and process the application filed by the petitioner for mutating her name in online web land register and 4 pass appropriate orders within a period of eight (08) weeks from the date of receipt of copy of the order. 5. With the above directions the disposed of. present writ petition is There shall be no order applications, if any, shall stand closed. as to costs.
