P.P. ------ 2/16.10.2025 Heard learned counsel appearing on behalf of Petitioners and learned APP appearing on behalf of the State. 2. The petitioners are apprehending their arrest in connection with Bariyatu P.S. Case No.14 of 2025, for the alleged offences registered under Sections 15(c), 17(c), 18(b), 22, 25, 29 of the N.D.P.S. Act, pending in the Court of learned Special Judge (N.D.P.S.), Latehar. 3. Learned counsel appearing for the petitioners submits that there are general and omnibus allegations against 37 persons and the same allegations are made against these petitioners and further allegations are made that poppy plants were being cultivated in the forest area. He further submits that even the land is not belonging to the petitioners and the petitioner No.1 and 2 have got no criminal antecedent as disclosed in para 11 of the petition, except petitioner No.3. He further submits that identically situated 15 co-accused have been granted anticipatory bail in ABA No.5010 of 2025 by order dated 01.09.2025. 2025:JHHC:32192 2 4. Learned counsel for the State opposed the prayer and submits that allegations are there against the petitioners. 5. In view of the above and considering that petitioner No.1 and 2 have got no criminal antecedents as disclosed in para 11 of the petition, except petitioner No.3. and the criminal antecedent is not only the ground to grant or reject the anticipatory bail, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Special Judge (N.D.P.S.), Latehar, in connection with Bariyatu P.S. Case No.14 of 2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023. 7.
