The petitioner is apprehending his arrest in connection with Complaint Case No. 1556 of 2024, registered for the offences under Section 33 of the Indian Forest Act, 1972 (Bihar Amendment Act, 1989), pending in the court of learned Chief Judicial Magistrate, Koderma.

Learned counsel appearing for the petitioner submits that false allegations are made of excavating the mica scrap. He submits that the petitioner happened to be the labourer and he earns his livelihood by doing the daily wage work. He next submits that the forest guard has wrongly disclosed the name of the petitioner. He then submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-21 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of excavating the mica scrap.

Considering that the petitioner is said to be a labourer and

he earns his livelihood by way of doing the daily wage work and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-21 of the petition, I am inclined to provide the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is hereby
directed to surrender before the learned court within three weeks from today, and in the event of her surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Complaint Case No. 1556 of 2024, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
