Order 07/03/2025
Learned counsel for the accused petitioners submits that the accused petitioners are in possession of the CCTV footage of the alleged incident, which could prove the innocence of the accused petitioners as they are not being seen in the CCTV footage at the relevant time at the place of occurrence. Counsel further submits that the police is not accepting the said CCTV footage. The Investigating Officer is directed to accept the CCTV footage if the accused petitioners approach him and submit the same.
[2025:RJ-JP:10523] (2 of 2) [CRLMP-8312/2024] On submission of the CCTV footage, the Investigating Officer shall examine the same and shall given its own decision as regards the innocence of the accused petitioners. The accused petitioners are allowed 10 days' time to submit the CCTV footage to the Investigating Officer. Till the Investigating Officer takes any decision on the CCTV footage, no coercive action shall be taken against the accused petitioners. In case the accused petitioners fail to submit the CCTV footage within the given period of 10 days, this order will automatically cease its effect. Accordingly, this misc. petition is disposed of with liberty to the accused petitioners to file fresh petition if they have any grievance after decision of the Investigating Officer.
