Ranjan Sharma, Judge Appellant-National Highways Authority of India, has come up in instant appeal under Section 37 of Arbitration and Conciliation Act, 1996 [as amended from time to time] assailing the judgment dated 17.05.2022 [Annexure A-1] passed by the Learned District Judge, Mandi, dismissing the objections filed under Section 34 of the Act and in affirming the Award dated 22.12.2017 passed by Learned Arbitrator-cum-Divisional Commissioner, 1 Whether reporters of Local Papers may be allowed to see the judgment? 2025:HHC:38816 Mandi, relating to land acquisition proceedings on 4-lane road i.e. Bilaspur-Nerchowk, NH-21, falling in Revenue Estate Jarol, Tehsil Sundernagar, District Mandi, Himachal Pradesh. 2. Learned Counsel for the Appellant and Respondents jointly represent that subject matter in the instant appeal already stands adjudicated by a Co-ordinate Bench of this Court in Arbitration Appeal No.112 of 2024, In Re; National Highway Authority of India Versus Husan Lal alongwith connected matters, decided on 17.10.2024 [Taken on Record], whereby, the appeal filed by the Appellant-NHAI has been dismissed and the judgment passed by the Learned District Judge as well as the Award has been affirmed. 3. Considering the fair stand taken by Learned Counsel representing the parties herein, the instant appeal also meets the same fate of dismissal. 4. Accordingly, the instant appeal is dismissed and the reasons recorded by the Co-ordinate Bench of this Court in the of case of Husan Lal 2025:HHC:38816 and connected matters [supra] shall mutatis mutandis apply in the facts and circumstances of the instant appeal.
