The impugned order dated 8.11.2007 is reproduced hereinafter: "गग्राम सभग्रा स्यग्रारमऊ रग्राम लग्राल वविकग्रास खण्ड मदनपपुर ससे चग्रार वशिकग्रा वमतत्रों कसे चयन हसेतपु आविसेदन आमननतत वकयसे गयसे थसे। जजिसमम प्रथम विररीयतग्रा पर शरीमतरी ककं चन प्रभग्रा , वद्वितरीय विररीयतग्रा पर शरीमतरी ममतग्रा, ततृतरीय विररीयतग्रा पर शरी वशिविकग्रानत एवि चतपुथर विररीयतग्रा पर शरी शरी कतृ ष्ण ककी चयन हसेतपु सकंस्तपुवत कर गग्राम वशिकग्रा सवमवत नसे पतग्राविलरी कको जजिलग्रा चयन सवमवत कको अनपुमग्रादन हसेतपु भसेजिग्रा। उसरी ददौरग्रान चतपुथर विररीयतग्रा पर प्रस्तग्राववित शरी शरी कतृ ष्ण ककी मतृत्यय हको गयरी अततः जजिलग्रा चयन सवमवत द्विग्रारग्रा प्रथम वद्वितरीय , ततृतरीय एविकं चतपुथर विररीयतग्रा कसे स्थग्रान पर अगलसे (पग्राकंचविसे) विररीयतग्रा विग्रालसे आविसेदक कग्रा चयन कर वदयग्रा । गग्राम सभग्रा स्यग्रारमऊ रग्रामलग्राल वविकग्रास खण्ड मदनपपुर ककी वशिकग्रा वमत पद हसेतपु आविदसेक शरीमतरी कदौशिल कपु मग्राररी पत्नरी स्वि० शरी शरी कतृ ष्ण नसे अपनसे पत वदनग्राकंक 25-8-07 कसे द्विग्रारग्रा अविगत करग्रायग्रा हहै वक " मसेरसे पवत शरी शरी कतृ ष्ण जिको चतपुथर विररीयतग्रा पर थसे। इनककी प्रवशिकण लसेनसे ससे पयविर मतृत्यय हको गयरी । प्रधग्रान नसे मसेरसे पवत कसे मतृत्यय सम्बनधरी कग्रागजिग्रात पतग्राविलरी मम लगविग्राकर मसेरसे पवत कसे स्थग्रान पर मतृतक वदखग्राकर प्रसेम कपु मग्रार कग्रा चयन करविग्रा वदयग्रा और उसनसे प्रवशिकण भरी प्रग्राप्त कर जलयग्रा हहै जिबवक ममनसे भरी आविसेदन वकयग्रा थग्रा और मसेरसे पवत कको मतृत मग्रानकर उनकग्रा चयन रद्द वकयग्रा गयग्रा हहै परनतपु मपुझसे वविधविग्रा नहहीं मग्रानग्रा गयग्रा। अगर वविधविग्रा ककी छय ट प्रदग्रान करतसे हहए 10 लब्धग्राकंक दसे वदयसे जिग्रातसे तको प्रसेम कपु मग्रार कसे स्थग्रान पर मसेरग्रा चयन हकोतग्रा"। सग्राथ हरी शरीमतरी कदौशिल कपु मग्राररी पत्नरी स्वि० शरी शरी कतृ ष्ण नसे नयग्राय ककी मग्रामाँग करतसे हहए कहग्रा वक प्रसेम कपु मग्रार कग्रा चयन वनरस्त करतसे हहए उसकग्रा चयन वकयग्रा जिग्राय । शरीमतरी कदौशिल कपु मग्राररी कसे उक्त पत कको बरी०आर०सरी० समनवियक नसे वदनग्राकंक 25-8- 07 कको सकंस्तपुवत कर वविचग्रार करनसे हसेतपु जजिलग्रा चयन सवमवत कको प्रस्तपुत वकयग्रा। चयकंवक शरी शरी कतृ ष्ण ककी मतृत्यपु कसे उपरग्रानत इनककी आविसेदक पत्नरी शरीमतरी कदौशिल कपु मग्राररी कको वविधविग्रा कसे 10 लब्धग्राकंक प्रदग्रान करतसे हहए चयन वकयग्रा जिग्रायसे तको शरीमतरी कदौशिल चतपुथर विररीयतग्रा कसे स्थग्रान सपर आतरी जजिसकसे अनपुसग्रार शरी प्रसेम कपु मग्रार कग्रा स्थग्रान पर शरीमतरी कदौशिल कपु मग्रार कग्रा चयन हकोनग्रा चग्रावहयसे । अततः तत्कग्राल प्रभग्रावि ससे शरी प्रसेम कपु मग्रार वशिकग्रा वमत , प्रग्रा०ववि० स्यग्रारमऊ रग्राम लग्राल वविकग्रास खण्ड मदनपपुर कग्रा चयन वनरस्त वकयग्रा जिग्रातग्रा हहै एविकं शरीमतरी कदौशिल कपु मग्राररी कग्रा प्रग्रा०ववि० स्यग्रारमऊ रग्रामलग्राल कसे वशिकग्रा वमत पद पर चयन वकयग्रा जिग्रातग्रा हहै।" 2. The petitioner (Prem Kumar) has filed this writ petition challenging the aforesaid and this Court has passed the following order on 16.1.2008: "Learned standing counsel appearing for the respondents no. 1 and 2, Sri R.K. Malviya learned counsel appearing for respondents no.3 and 6, and Sri V.K. Singh learned counsel appearing for respondent no.4 are allowed four weeks time to file counter affidavit. Issue notice to respondent no. 5 by Registered Post A/D. Steps to be taken within a week. List this petition for admission after expiry of four weeks, by which time the said respondent will also file counter affidavit. Till the next date of listing, the effect and operation of the order dated 8.11.2007 passed by the District Magistrate, Firozabad shall remain stayed." 3. None appears on behalf of the petitioner to press this writ petition. 4. The order-sheet indicates that the aforesaid interim order was extended and counter affidavit was filed. Despite the opportunity, no rejoinder affidavit was filed and the matter thereafter was adjourned on one or other reasons.This writ petition was dismissed due to non-prosecution on 29.11.2012 and thereafter, this writ petition was restored by an order dated 21.3.2013. However, it appears that interim order was not extended. Even an application was filed in the year 2014 for extension of it but neither it was pressed nor considered. The amendment application was also filed and necessary amendment was allowed to challenge the subsequent order passed against the petitioner. However, it appears that till date amendment has not been carried out. 5. In the aforesaid circumstances, it appears that petitioner and his counsel remain lethargic and therefore, they have not pursued this writ petition properly. 6.
