HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15623/2024 Manohar Lal Son Of Shri Kishna Ram, Aged 32 Years, Resident Of Village Bhapdi, Post Karda, Tehsil Raniwada, Police Station Karda, Distt. Jhalore, Rajasthan (Accused Petitioner Presently Confined In Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through P.p. ----Respondent For Petitioner(s) : Mr. Vedant Sharma with Mr. Shivam Sharma For Respondent(s) : Mr. Jitendra Singh Rathore, Addl.G.A. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 27/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 23/2024 registered at Police Station S.O.G., District ATS & SOG for the offence(s) under Sections 419, 420, 467, 468, 471 and 120-B of IPC and Sections 2(F) (II), 3, 7 and 10 of The Rajasthan Public Examination (measures for prevention of unfair means in recruitment) Act 2022 and Sections 66(C) and 66(D) of IT Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. The accused petitioner is in custody since 23.08.2024 and the trial of the case will take considerable time. There are no criminal antecedents against the petitioner and charge-sheet has already been submitted before the concerned court. Therefore, the benefit of bail may be granted to the accused-petitioner. (2 of 2) [CRLMB-15623/2024] Per contra, learned Public Prosecutor opposes the bail application and contended that petitioner appeared as a dummy candidate in the examination conducted by RPSC and forged the document of the actual candidate and also obtained huge amount from the candidates therefore considering the allegations levelled against the petitioner, bail application of the accused-petitioner deserves to be dismissed. Heard and perused the material available on the record. Considering the arguments advanced by counsel for the parties and looking to the fact that accused-petitioner is behind the bars since 23.08.2024 and charge-sheet has already been produced before the concerned trial court. The trial of the case will take considerable time and there are no criminal antecedents against the petitioner, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Manohar Lal Son Of Shri Kishna Ram, in connection with FIR No. 23/2024 registered at Police Station S.O.G., District ATS & SOG shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
