2. The petitioner is apprehending his arrest in connection with Dhanbad R.P.F. Case No. 25 of 2025, registered under sections 3 RP(UP) Act, pending in the Court of learned Railway Judicial Magistrate, Dhanbad.

Learned counsel for the petitioner submits that petitioner has nothing to do with removal of railway line of 42 meters. He further submits that petitioner is not named in F.I.R. and the name of the petitioner has come on the basis of confessional statement of co-accused. He also submits that petitioner has got no criminal antecedent which is disclosed in para 8 of the petition and no incriminating article has been recovered from the possession of the petitioner. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State and Union of India oppose the prayer and submits that 42 meters railway line has been removed by the miscreants.

Considering that petitioner is not named in F.I.R., the name of the petitioner has come on the basis of confessional statement of co-accused and petitioner has got no criminal antecedent which is disclosed in para 8 of

the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Railway Judicial Magistrate, Dhanbad, in connection with Dhanbad R.P.F. Case No. 25 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
