HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 8469 OF 2024 ORDER: As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025. 2. This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioner-accused No. 6 seeking to release him on bail in the event of arrest in crime No. 555 of 2024 of Ongole Taluk Police Station, Prakasam District, registered for the offences punishable under Sections 420, 467, 468, 471, 379 and 120-B read with Section 34 IPC. 3. Heard Sri N.Ravi Prasad, learned counsel appearing for the petitioner-accused No. 6, and learned Additional Public Prosecutor appearing for the respondent-State. 4. Case of the prosecution is that on 01-05-2023, accused No. 1 introduced accused Nos. 2 to 5 to de facto complainant. Accused No. 1 requested de facto complainant to lend an amount of Rs.1,00,000/- in the name of accused No. 2 by keeping his car 2 bearing registration No. AP 39 NR 6615 in his custody. It is further alleged that they also executed promissory notes and issued blank cheques. It is also alleged that after two months, the petitioner- accused No. 6 went to the house of de facto complainant and took away the said car with the help of duplicate key. Later, de facto complainant came to know that the promissory notes and the blank cheques issued by accused No. 1 were fake. Thereafter, de facto complainant approached police and gave a report, on the basis of which the present crime has been registered against accused Nos. 1 to 5 and the petitioner herein. 5. Learned counsel appearing for the petitioner-accused No. 6 contends that the petitioner-accused No. 6 has nothing to do with the alleged transactions between accused Nos. 1 to 5 and de facto complainant and that though the alleged offence took place on 01-05-2023, de facto complainant gave report on 19-09-2024 i.e. nearly one year four months thereafter. Learned counsel submits that accused Nos. 1, 3 and 4 are already granted regular bail by the trial Court. He therefore requests this Court to grant anticipatory bail to the petitioner-accused No. 6. 3 6. On the other hand, learned Additional Public Prosecutor did not dispute the factum of granting regular bail to accused Nos. 1, 3 and 4 by the trial Court. 7. In view of the above facts and circumstances of the case, as accused Nos. 1, 3 and 4 have already been granted regular bail by the trial Court, this Court is inclined to grant anticipatory bail to the petitioner-accused No. 6 with certain conditions. 8. The petitioner-accused No. 6 is, therefore, directed to surrender before the Station House Officer, Ongole Taluk Police Station, Prakasam District, on or before 10-04-2025. On such surrender, the petitioner-accused No. 6 is ordered to be enlarged on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Ongole Taluk Police Station. The petitioner-accused No. 6 is directed to cooperate with the investigating agency and not to tamper with the prosecution witnesses. 9. Accordingly, the criminal petition is allowed.
