ORAL ORDER Sri.Satish.T.S., counsel for the petitioners and Smt.Padma S.Uttur., counsel for respondents 1 and 2 have appeared through video conferencing. Sri.B.T.Thyagaraja., counsel for respondent No.3 has appeared in person. There is no representation on behalf of respondents 4 and 5, either personally or through video conferencing. As could be seen from the daily order sheet, the petition was listed on 26.06.2025, on that day, there was no representation on behalf of respondents 4 and 5.
Hence, for appearance of counsel for respondents 4 & 5 and the appeal was ordered to be listed on 27.06.2025, and it was also made clear that if none appears for respondents 4 and 5 on the next date of hearing, the Court will proceed to pass appropriate

orders. The petition is listed today. As already noted above, today also there is no representation on behalf of respondents 4 and 5. Hence, this Court proceeds to pass appropriate orders. 2. The captioned Writ Petition is filed seeking following reliefs: A. Issue a Writ of Certiorari to quash the order of disconnection/ withdrawal of the Electricity connection to the petitioners residential houses in respect of schedule B in item No.1 with electricity connection bearing R.R.No.C4 LG 90290 (Annexure-C) and residential house of petitioner No.2 in respect to property in Schedule B in item No.1 with electricity connections bearing R.R.Nos. C4 LG 90298, C4 LG 90291 to C4 LG 90297 (total 9 connections) vide Annexures-E1 to E8 on the application of respondent No.4 for disconnection to respondents 1 and 2 at Annexure-A pending disposal of the civil dispute between respondent No.3 and respondents 4 & 5 in O.S.No.2829/2022 on the file of Civil Judge Court at Bangalore (CCH-8). B. Direct the respondents to restore the electricity to provide the interrupted supply of Electricity to the residential homes of petitioner No.1 in

respect of property in Schedule B in item No.1 with electricity connection bearing R.R.No.C4 LG 90290 Annexure-C and residential homes of petitioner No.1 in respect of property in Schedule B in item No.2 with electricity connections bearing R.R.Nos. C4 LG 90298, C4 LG 90291 to C4 LG 90297 (total 9 connections) Annexures-E1 to E8. C. Pass such other appropriate order/ direction to respondents 1 & 2 and consequently also binding respondents 3 to 5. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the writ papers with care. 4.
Suffice it to note that the third respondent filed a suit seeking the relief of specific performance against respondents 4 and 5 in O.S.No.2829/2022 on the file of City Civil Judge, Bangalore and the same is pending as of today. The petitioners claim that they are the tenants under respondent No.3. The Writ Petition relates only to restoration of electricity connection to the petitioners property. By virtue of an interim order dated 20.12.2022, the BESCOM Authorities have restored the electricity connection to the R.R.Nos.C4 LG

90290 and R.R.Nos.C4 LG 90298, C4 LG 90291 to C4 LG
90297. The Writ Petition is disposed of. The power supply to R.R.Nos.C4 LG 90290 and R.R.Nos.C4 LG 90298, C4 LG 90291 to C4 LG 90297 is subject to the outcome of the suit in O.S.No.2829/2022.
