CMP(M) No.1831 of 2025 Counsel for the State submits that the matter pertaining to whether the married daughter of the deceased is to be construed as a family member for considering the annual family income for compassionate appointment, is also subject matter of consideration in LPA No.233 of 2025 titled State of H.P. and others vs. Desh Raj, which is now pending for 22.12.2025. 2. It is pointed out that in CWP No.4072 of 2021 titled Anurodh Singh vs. State of H.P. and others, decided on 23.04.2024, the learned Single Judge has taken a similar view and not the view which has been taken in the judgment under consideration. 3. Keeping in view the above and the averments made in the application which is duly supported by an affidavit, a question of law arises; therefore, the application for condonation of delay of 131 days in filing the appeal is allowed. 4. Application stands disposed of. 5. Appeal be registered. LPA No._____ of 2025 6. Let notice be issued to the sole respondent returnable within a period of four weeks on taking steps within a week. 7. To be heard along with LPA No.233 of 2025 on 22.12.2025. 8. In the meantime, operation of the judgment shall remain stayed. ( G.S.
