GP FOR EDUCATION (AP) 2 The Court made the following: ORDER: This Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief: “ .... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd and 3rd Respondents insisting petitioner to take Fire No Objection Certificate every year by paying fee as per G.O.Ms.71 as illegal, arbitrary, un-constitutional and contrary to Andhra Pradesh Fire Service Act 1999 and its Rules and consequently direct the 2nd respondent to grant license as per Section 17 of the Act and grant such other license and to pass ...” 2. Learned counsel for the Petitioner would submit that respondents 2 and 3 are insisting the Petitioner to take Fire No Objection Certificate every year by paying fee as per G.O.Ms.No.71 Home (Prisons.A) Department, dated 01.04.2010. Learned counsel sought for a direction to respondent No.2 to grant licence as per Section 17 of the A.P.Fire Service Act. 3. Learned Assistant Government Pleader for Home appearing for respondent-Police, on instructions would submit that on similar issue, this Court by Order dated 19.04.2024 disposed of a batch of Writ Petitions in WP No.8476 of 2016 & Batch. The Court may pass appropriate orders. 4. Considering the submissions, it is apposite to direct respondent authorities to inspect the premises of the petitioner and take an appropriate decision with regard to issuance of Fire NOC to the petitioner in terms of G.O.Ms.No.71 Home (Prisons.A) Department, dated 01.04.2010 and in the light of the Common Order passed by this Court in WP No.8476 of 2016 & batch dated 19.04.2024. 3 5.
