1.PUBLIC PROSECUTOR The Court made the following order I.I A.4 in Crime No.98 of 2023 of Rangampeta Police Station, East Godawari District, filed the present application under Section 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking his release on bail. The said crime was registered for the Offence under Section. 8(c) read with 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act,1985. -, i. _ial

2. The case of prosecution is that on 15.O5.2023 at about 5.30 P.M,, on receipt of the credible information about the transportation of Ganja, the Sub Inspector of police, Rangampeta Police Station along with his staff and mediators apprehended A.5 to A.7, who were transporting 24.9 kgs of Ganja in a Maruthi Swift Dzl're car bearing No.AP 39 TM 9507. After conducting panchanama and after seizing the contraband, the S.I of police arrested A.5 to A.7, who were remanded to judicial custody.
During the course of investigation, A.5 to A.7 confessed before the Investigating Officer that they procured the contraband with the active assistance of A.1 to A.4. On the basis of the said confession, the petitioner/A.4 was arrested on 03.08.2024 and ever since he is in judicial custody. 3. Learned counsel for the petitioner contends that he came to be implicated only on the confession made by A.5 to A.7. He further contends that no contraband was seized from his possession. He further contends that the other accused were already enlarged on bail by this Court. He also further contends that the contraband involved in the present crime is 24.9 kgs, which is a little bit higher than the non- commercial quantity. As the petitioner is in judicial custody since 03.08.2024, he requests this court to enlarge the petitioner on bail. 4. On the other hand, learned Additional Public Prosecutor confirms the factum of granting bail to the other accused by this Court. 5. This Court perused the material on record. 6. In view of the aforesaid facts and circumstances of the case, as the other accused were already enlarged on bail by this court, the petitioner can also be granted bail with certain conditions : - cre--e

The petitI-Oner hereI'n Shall be released on bail on hl's executing a personal bond for Rs.50,OOO/- (Rupees fifty thousand only) with two sureties for a lI'ke Sum each to the satisfaction of the learned Additional Judicial Magistrate of First class, Peddapuram ,| On release, the petitioner shall appear before the station House Officer, concerned, twice in a week i.e., every Monday and Thursday between 10.00 a.m. to o1.00 p.m., untI|l further orders ,| and Further, the petitioner is directed to co-operate with the investigation and also the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. 7. Accordingly, the criminal Petition is allowed.
