Neutral Citation No. - 2025:AHC:58854-DB Court No. - 40 Case :- WRIT - C No. - 9253 of 2025 Petitioner :- Smt. Vijaya Dubey Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Arvind Srivastava,Ashish Rai Counsel for Respondent :- A.S.G.I.,Komal Mehrotra Hon'ble Shekhar B. Saraf,J. Hon'ble Dr. Yogendra Kumar Srivastava,J. 1. Heard Sri Arvind Srivastava, learned counsel appearing on behalf of the petitioner and Sri Vaibhav Tripathi, learned counsel for the respondent nos.2 and 3. 2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following substantial relief: "I. Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 29.05.2024 (Annexure No.1 of this Writ Petition) passed by the Regional Manager, Hindustan Petroleum Corporation Ltd. Gorakhpur Retail Regional Office, Prashant Towers (Ground Floor), Mahewa Chungi, Near Old Transport Nagar Police Chowki, Gorakhpur- 273016." 3. Upon reading of the order passed by the respondent authority, we are of the view that the order does not spell out the specific reasons for which the application of the petitioner has been rejected. 4. In light of the same, we are of the view that an appropriate reasoned order should be passed by the authority concerned. 5. Accordingly, the impugned order dated 29.05.2024 passed by respondent no.3 is quashed and set aside. The authority concerned is directed to grant an opportunity of hearing and pass a reasoned order in accordance with law. The petitioner shall be at liberty to produce any further documents that she may rely upon in accordance with law. 6. With the above, directions, the writ petition is disposed of. 7. It is to be noted that in the present case another order was passed with regard to another applicant wherein this Court has also directed the authority concerned to pass a reasoned order in accordance with law. 8. Needless to mention that since another applicant was already provided liberty, his case may be considered first and thereafter the case of the present petitioner.
