Notice. Mr. Janesh Mahajan, learned counsel, appears and accepts notice on behalf of respondent.
2. Petitioner alleges breach of decision rendered in Sarup Chand versus Chaudhary Shrawan Kumar Himachal Pradesh Krishi Vishvavidyalaya2 wherein by allowing the petition, the following operative directions were issued:-
“In view of above, the writ petition is allowed. The service rendered by the petitioner from the date of his initial appointment i.e. 13.07.2007 is directed to be considered as qualifying service towards the pension. Respondent is also directed to issue appropriate consequential order within six weeks in favour of the petitioner. The amount paid to the petitioner towards Contributory Pension Scheme shall be liable to be adjusted. Pending miscellaneous application(s), if any, shall also stand disposed of.” 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 CWP No.10312/2024, decided on 03.09.2025

At this stage, learned counsel for the respondent has placed on record office order dated 13.11.2025 and submits that respondent has already passed the consideration order whereby the co-terminus service as rendered by the petitioner w.e.f. 17.07.2007 to 10.07.2018 has been ordered to be counted as qualifying service for the purpose of granting the benefit of pension under Old Pension Scheme as notified on 19.05.2023. Learned counsel further submits that consequential action based upon aforesaid office order i.e. payment of pension and arrears thereof shall be passed/given effect within four weeks from today i.e. by or before 14.01.2026.
4. In view of office order dated 13.11.2025 and submission made by learned counsel for the respondent, the present proceedings are closed. Notice issued to the respondent stands discharged. Respondent to adhere to it its assurance of paying the pension arrears/ recurring pension to the petitioner within the above period.
