State Of Rajasthan, Through PP 2. Uttam Sharma S/o Late Shri Gopichand Sharma, R/o House No. D-3, Near Maharani School, Meera Marg, Banipark Police Station Banipark, Jaipur (West) Raj. ----Respondents For Petitioner(s) : Mr. Rajveer Singh Gurjar Mr. Avtar Singh Rathore For Respondent(s) : Mr. Sudesh Saini, PP Mr. Deepak Chauhan Mr. Ajay Shukla HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 01/04/2025 The instant S.B. criminal bail cancellation application is preferred by the complainant Eklavya Singh on the ground that learned special Court despite recording the fact that one criminal case is pending against respondent No. 2 enlarged the respondent No. 2 on bail vide impugned order dated 26.11.2024. The offence alleged against the respondent No. 2 are grave in nature, therefore, the bail granted to respondent No.2 may be cancelled. Learned counsel for the respondent vehemently opposed the bail application and contended that the court below after considering the entire material available on record enlarged the respondent No. 2 on bail. It is also contended that respondent No. (2 of 2) [CRLBC-177/2024] 2 has not breached any condition enshrined in the bail order. The offences alleged against the respondent are triable by Magistrate and charge-sheet has already been produced against the respondent No. 2 before the concerned court, the application is devoid of any merits. Heard and perused the material available on the record. Considering the fact that the respondent No. 2 has not breached any condition enshrined in the bail order, the trial court after considering the entire material available on the record has enlarged the respondent No. 2 on regular bail filed under Section 439 Cr.P.C. This court do not find any infirmity in the said order, accordingly, the instant S.B. criminal bail cancellation application is hereby dismissed. (PRAVEER BHATNAGAR),J ashu /16
