JUSTICE PRAVEER BHATNAGAR
Order 23/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 22/2023 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) under Sections 420, 419, 467, 468, 471 and 120-B of IPC and Sections 43, 66 and 66-D of IT Act and Sections 3, 6 and 10 Of Rajasthan Public Examination (Use Of Unfair Means) Act,
2022.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is alleged against the petitioner that in Examination conducted by the RPSC, petitioner did not appear in person rather in his place two persons namely Dinesh and Suresh appeared. The accused petitioner is in
[2025:RJ-JP:3462] (2 of 2) [CRLMB-15429/2024] custody since 05.08.2024, there is no criminal antecedents against the petitioner, the trial of the case will take considerable time and the charge-sheet submitted is itself voluminous. Considering the period of incarceration, bail application of petitioner may be allowed. Per contra, learned Public Prosecutor opposes the bail application. In pursuant to the direction of this court, investigating officer is present in person. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the fact that petitioner is in custody since 05.08.2024 and trial of the case will take considerable time furthermore charge-sheet has already been produced, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ramesh Kumar Rana S/o Shri Dhukharam Rana, in connection with FIR No. 22/2023 registered at Police Station Special Police Station (SOG), District ATS and SOG shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
