No. 43 of 2025 4) Heard. 5) Having left the parties to agitate the matter before the learned civil court, we are of the considered view that the learned writ Court ought not to have made any observation which could affect the merits of the case of either of the parties. 2025:JHHC:31888-DB 6) Accordingly, we relegate the parties to agitate the dispute before the learned civil court and make it clear that any observation in the order dated 8th August 2024 shall not come in the way of either of the parties and in the event of the civil court being approached, the said court shall proceed to decide the case totally uninfluenced by any of the observations made in the order dated 8th August 2024 passed in W.P.(C) No. 7049 of 2017 and decide the case on the basis of the material coming on record. 7) Accordingly, this letters patent appeal is disposed of.
