This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, as he was arrested in connection with Crime No. 90/2025 registered at Police Station – Bhilai Nagar, District – Durg (C.G.) for the offence punishable under Sections 296, 351(2), 119(1), 115(2), 3(5), 318(3) and 351(3) of BNS. 2. 2 Bhilai Nagar to the effect that on 01-02-2025, at around 10:00 pm, he was sitting on the stairs of Dhobi Bhawan near Sheetla Talab Ruabandha and using mobile, at the same time present applicant along with two other co- accused namely Pappu Kandra and Bems Chhotu of Ruabandha came to him and asked for money from him to buy liquor and they started demanding money from him. When he refused, other co accused and present applicant together started abusing the complainant and threatened to kill him and started beating him with their fists. He was trying to free himself when one co accused Pappu Kandra hit him on his shoulder with something which injured his shoulder and started bleeding. On the basis of the above report of the applicant, Bhilai Nagar Police Station registered a case number 90/2025 against the present applicant and other co accused under sections 296, 351(2), 119(1), 115(2), 3(5) of IPE and filed a charge sheet under sections 296, 351(2), 119(1), 115(2), 3(5), 318(3), 351(3) of IPC. Hence this bail application on followings ground. 3.
The learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that prosecution has not presented any incriminating circumstances or evidence that could establish the applicant’s guilt in this case. He also submits that applicant is having 11 previous criminal antecedents, out of which 9 cases are pending. The applicant is in jail since 03.03.2025 and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel appearing for the respondent/State opposes the bail application and submits that applicant is having 11 previous criminal antecedents under the various sections, out of which 9 cases are pending and that present
3 applicant along with two other co- accused namely Pappu Kandra and Bems Chhotu of Ruabandha came to injured home and asked for money from him to buy liquor and they started demanding money from him. When he refused, other co-accused and present applicant together started abusing the complainant and threatened to kill him and started beating him with their fists therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of offence, period of detention of the applicant, particularly considering the fact that applicant is having 11 previous criminal antecedents, out of which 9 cases are pending, looking to the conduct of the present applicant and fact that he has misuse the liberty granted him earlier, this Court does not find it a fit case to release the applicant on bail. 7. Accordingly, this bail application of applicant – Siddharth Sethi, involved in Crime No. 90/2025 registered at Police Station – Bhilai Nagar, District – Durg (C.G.) for the offence punishable under Sections 296, 351(2), 119(1), 115(2), 3(5), 318(3) and 351(3) of BNS, is rejected at this stage. 8.
