1. Through the medium of the instant petition filed under the provisions of Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 (hereinafter referred to as the BNSS for short), the petitioner has sought the quashment of the FIR bearing No. 45 of 2021 registered with Police Station Channi Himmat, Jammu on the main ground that he is related to the private respondents 2 to 7, who are the accused in the case FIR. That there was some civil dispute going on between them since last few years. That on 13.04.2021, when he came back from the house of his relatives, he witnessed some damage to his boundary wall that was made from mud and grasses. That he on the basis of some misconception lodged a complaint against the private respondents 2 to 7 at the Police Post Sainik Colony, Jammu. That subsequently due to the intervention of some of the relatives of both the parties, they arrived at a mutual consensus and executed a compromise deed duly notarised dated 19.02.2025. That the continuance of the criminal proceedings is likely to effect the mutual relation between the parties. Sr. No.03

2. The statements of the petitioner and the respondents 2, 3 and 7 stand already recorded in attestation of this petition on 03.06.2025.
3. I have heard the learned counsel for the parties. The learned UT counsel Mr. P. D. Singh, Dy. AG submitted that he has got no objection in deciding the matter in accordance with the law. The learned counsel for the petitioner and the respondents 2 to 7, however, unanimously submitted that the parties are closely related and have already compromised the matter. They further submitted that continuance of the criminal proceedings initiated by the petitioner as complainant against the private respondents 2 to 7/accused is likely to adversely affect their relation.
4. In the light of the perusal of the record of the petition and the
consideration of the submissions of the learned counsel for the parties, this Court is of the opinion that it may meet in the ends of justice, in case the petition is allowed and the impugned case FIR bearing No. 45 of 2021 registered with Police Station Channi Himmat, Jammu is quashed.
5. It is, accordingly, ordered.
