In as much as the issue involved in these writ petitions are similar and they were heard together and are being disposed of by Common Order. 03. Heard Sri Jada Sravan Kumar, learned counsel for the petitioners and Sri Gurram Rama Chandra Rao, learned Government Pleader appearing for the respondents. Learned counsel for the petitioners while reiterating the 04. contents of the affidavit submitted that, the petitioners are landless poor persons and on their request, the revenue authorities have issued d-form patta and also issued pattadar passbooks to the petitioners way back in the year 2016 and ever since they are in possession of their respective subject properties. Now respondent authorities, without following due procedure contemplated under law trying to dispossess the petitioners from their subject property. This court taking into consideration the material available on record granted an order of status quo on 06.01.2022. In these circumstances, if the respondents are allowed to dispossess the petitioners 3 highhandedly in a manner unknown to law, the petitioners’ rights will be affected, accordingly, prayed to pass appropriate orders protecting the interest of the petitioners. 05. On the other hand, Sri Gurram Rama Chandra Rao, learned Government Pleader, on counter contended that the documents which are relied by the petitioners are all fabricated documents and the revenue authorities never issued d-form patta in their favour. The Tahsildar, who signed the said documents was never worked during that period in that station. Subsequently, the said Tahsildar died. This Court cannot consider the petitioners’ case and the writ petitions have to be dismissed with costs. Infact suo moto criminal cases have to be booked against them as they are relying on the fabricated documents. The pattadar passbooks placed on record are in the name of the petitioners, however in the records some other names are found place. As such, no indulgence can be shown on the petitioners and accordingly prayed to dismiss the writ petitions. Perused the material available on record and considered the submissions made by both the parties. 06. 4 07. The petitioners are claiming to be in possession of the subject properties by virtue of d-form pattas, said to have been issued by the Tahsildar in the year 2016. The pattadar passbooks placed on record are in the names of the petitioners’. 08. The contention of the respondents is that those documents are fake and fabricated and the Tahsildar who signed on the d- form patta has not worked as Tahsildar in the said station. Further contention is that though the pattadar passbook are filed before this Court, in their records somebody else names found place. The petitioners got filed the present writ petitions on 29.12.2021. This Court granted interim orders on 06.01.2022 which read as follows; It is directed to maintain status-quo with regard to the subject survey numbers mentioned in the present writ petitions 09. The learned Government Pleader’s contention is that though counters have been field in the year 2022 itself, the same were returned with the office objections, but however the same has been complied only in the year 2024 i.e., 19.10.2024. Out of 19 cases in two cases only vacate stay application has been moved. Further when it is noticed by the revenue authorities that 5 the petitioners are claiming the subject property through fabricated documents, it is not known what prevents them from filing counters in time. No reasons are coming forward. Further no action against such fabricated documents has been taken. The counter is silent as to when and how this was discovered. In the similar set of facts, this court in W.P.No.26086/2012 has very allowed the petition. In the said writ petition the cancellation of assignment has been questioned by the petitioners on the ground taken by the respondents that the documents are fabricated and fake, this court has taken a view that the respondents have not properly pleaded and proved the fabrication and fake pattas. In the present case also the respondents have not properly pleaded and proved that the documents relied by the petitioners are fake and fabricated. This Court cannot adjudicate and decide whether the documents are fabricated and fake. If the respondent authorities feel that the documents are fabricated, it is always left open for the respondents to initiate appropriate action in accordance with law. The material would indicate that the petitioners are in possession of the subject property, whether their possession is legal or illegal, the authorities have to follow the law before taking 10. 6 possession. This court is inclined to dispose of the writ petitions by passing the following common order. The respondent authorities are directed not to interfere with the possession of the petitioners the respective subject properties except due process of law. over Accordingly, these writ petitions are disposed of.
