Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 03/01/2025 1. These instant bail applications have been filed under Section 483 B.N.S.S. on behalf of the accused-petitioners. The accused- petitioners have been arrested in connection with FIR [2025:RJ-JP:413] (2 of 3) [CRLMB-15441/2024] No.226/2024 registered at Police Station Karwar, District Bundi for the offence(s) under Sections 189(2), 115(2) and 126(2) of B.N.S. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in these cases. He further submits that the injuries sustained to injured Moji Ram at his nose was found to be sharp and grievous in nature and the injuries sustained to injured Hari Ram and Kishan Lal are found to be simple blunt in nature. It is contended that there are no criminal antecedents against the accused-petitioners. The accused-petitioners are in judicial custody since long and charge- sheet has already been produced before the concerned Court. The trial/investigation of the case may take considerable time, therefore, considering the long incarceration of the accused- petitioners, the bail applications may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail applications. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by counsel for the parties and looking to the fact that the injuries sustained to injured Hari Ram and Kishan Lal were found to be simple blunt in nature. Similarly, apart from injury No.1, injuries sustained to injured Moji Ram was found to be simple blunt in nature and injury at his nose was found to be sharp and grievous in nature, therefore, considering the long incarceration of the accused- petitioners and the fact that there are no criminal antecedents against the accused-petitioners, trial/investigation of the case may take considerable time and without commenting anything on the [2025:RJ-JP:413] (3 of 3) [CRLMB-15441/2024] merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners namely: (1) Jagdish S/o Chitar, (2) Atmaram S/o Jagdish, (3) Ramprasad S/o Jagdish, & (4) Sharwan S/o Kalyan in connection with FIR No. 226/2024 registered at Police Station Karwar, District Bundi, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
