Swamulu, learned counsel for the petitioner and Sri Teja, learned Assistant Government Pleader for Stamps and Registration respondents 1 to 4. 2. The grievance of the petitioner is that respondent No.4 is not receiving and processing the document (sale deed) in respect of land admeasuring 250.55 square yards or 2255 square feet (vacant site) situated in survey No.623/3, Chinthalachenu area, 19*^ ward of Tirupati Town, within the limits of Tirupati Municipality, Tirupati Sub-Division, Chittoor District. 3. A counter affidavit was filed on behalf of respondent No.4. It was contended, inter alia, that an extent of Ac.61-63 cents in survey No.623 of Chintalachenu residential area, Tirupati village, is classified as ‘Endowment Land’ and has been included in the list of the prohibited properties. The Commissioner, Endowments, vide letter in Rc.No.L1/COE-19027(36)/ 1/2019 dated 19.12.2019 communicated the list of such prohibited properties, in different survey numbers, including Ac.61-63 cents in survey No.623 of Chintalachenu residential area, Tirupati village, to the District Registrar of Assurances Registration and Stamps Department, Chittoor, for inclusion in the list of prohibited properties, under Section 22(A) (1)(c) of the Registration Act, 1908 (for short ‘the Act’). Given the inclusion of the property in the list of prohibited properties, respondent No.4 is restrained from registering the document. Divya for 4. Learned counsel for the petitioner would submit that the petitioner purchased 250.55 square yards out of Ac.0-73 Va cents in survey No.623/3, Chinthalachenu area, 19‘^ ward of Tirupati Town, within the limits of Tirupati Municipality, Tirupati Sub-Division, Chittoor District, from Sidda Reddy and W.P.No.27444 of 2o. »r» since the date of purchase, the petitioner has been in possession and enjoynnent of the property. The petitioner, to meet the family expenses, intended to alienate the subject property and presented the sale deed before respondent No.4. However, respondent No.4 declined to receive and process the document for registration without assigning any reason. 6. Learned Assistant Government Pleader for Stamps and Registration reitefatgd the contentions as-per the averments in the counter affidavit. 7. No doubt, the petitioner purchased the property in survey No.623/3 under a registered document dated 17.04.1985. However, the Commissioner, Endowments Department, vide letter in Rc.No.L1/COE-19027(36)/1/2019 dated 19.12.2019 requested the District Registrar of Assurances Registration and Stamps Department, Chittoor to include the land of an extent of Ac.61-63 cents in survey No.623, along with land in other survey numbers, in the list of prohibited properties under Section 22(A)(1)(c) of the Act. Accordingly, the properties were included in the prohibited list of properties. 8. Given the inclusion of the subject land in the list of prohibited properties, under Section 22A (1)(c) of the Act, unless the property is deleted from the list of prohibited properties, the Sub-Registrar cannot receive and register the document presented by the petitioner. 8. The Government issued G.O.Ms.No.300 Revenue (Assignment-1), dated 05.07.2016, constituting a committee to address the grievances concerning the lands entered in the prohibitory lists under Section 22-A of the Act. The petitioner can also make an application, as per the G.O., so that the Committee will examine the issue and pass appropriate orders. 9. Given the G.O.Ms.No.300 Revenue (Assignment-1), dated 05.07.2016, since the subject land is included in the list of prohibited properties, this writ petition is disposed of giving liberty to the petitioner to make an application 5 of 6 SRS.J W.P.No.27444 of 2025 before the Committee constituted under aforementioned G.O., by annexing all the relevant documents, seeking deletion of the property from the list of prohibited properties under Section 22-A(1)(c) of the Act. Upon receipt of such an application, the learned Committee shall consider the same and pass appropriate orders in accordance with law. No order as to costs.
