---- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN
For the Petitioner : Mr. Arbind Kumar Choudhary, Advocate
For the State : Mr. Munna Lal Yadav, SC(L&C)-III
Mr. Ashok Kr. Singh, AC to SC(L&C)-III
For the Resp. No. 6: Mr. Vineet Prakash, Advocate
---- 12/ 07.10.2025 The instant application has been preferred by the petitioner praying for a direction upon the respondent No. 2 to dispose of the application filed by the petitioner along with several other villagers challenging the appointment of respondent No. 6 as Sewika of Aanganbari Centre, Bandhdih, as the appointment of respondent No. 6 was not accepted by Aam Sabha and she was not possessing the requisite qualification. 2. A preliminary objection has been raised by the respondents with regard to locus standi of this petitioner. However, from record it appears that the petitioner was a candidate and the very prayer that her representation was pending before the concerned Deputy Commissioner which has not been disposed of, inasmuch as, there is

no categorical averment in the counter-affidavit that any decision has been taken on the basis of representation of this petitioner and/or other villagers. 3.
Accordingly, since matter is of 2013 and respondent No. 6 is already working for more than 12 years; as such, interest of justice would suffice by directing the respondent No.2- the Deputy Commissioner, Deoghar to look into the matter and if it is found that there is any loophole in the appointment process, he would be at liberty to proceed in accordance with law and if after verification of record, he finds that there was no such error, then he should communicate the same to the petitioner. 4. Since there are several allegations with regard to coram etc.; as such, petitioner would serve the entire records of this writ application including counter-affidavit to the concerned respondents who shall see the allegation with their original records. The entire exercise shall be completed within a period of four months. 5. With the aforesaid observations and directions, the writ application stands disposed of. (Deepak Roshan, J.)
