A SREEKANTH REDDY(SC FOR ENDOW RS) The Court made the following Order: This Writ Petitionis filed, under Article 226 of the Constitution of India, seeking the following relief: “….to issue a Writ or order or Direction in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in conducting auction to the land of Ac.4-47 Cents, including Ac.15-00 Cents in Sy.No.310, situated at Kandukuru Village of Prakasam District is illegal, arbitrary 2 and consequently direct the respondents rot to evict the petitioner from the land of Ac.4-47 Cents in Sy.No.310 situated at kandukuru Village of Prakasam District….” 2. Today, when the matter is taken up for hearing, none appeared for the petitioner. 3. Heard Mr.P.Srinivas, learned Assistant Government Pleader for Endowments, for the respondents. 4. On hearing, learned Assistant Government Pleader submits that the respondents have issued auction notification for lands belongs to Sri Skandhapuri Janardhana Swamy Temple, Kandukuru covering an extent of Ac.157.00 cents in Survey No.297/1, Ac.2.26 cents in Survey No.796/1, Acs.12.05 cents in Survey No.305 and Ac.15.00 cents in Survey No.310. The petitioner filed the present writ petition challenging the auction to be conducted on a portion of the land, specifically an extent of Ac.4.47 cents, including the Ac.15.00 cents in Survey No.310, situated at Kandukuru Village of Prakasam District. He further submits that the auction is for a period of three years, from 2016-2017 to 2018-2019. The learned Assistant Government Pleader has furnished a copy of the written instructions vide D.Dis.No.A5/ENDW-PADM/161/2023, dated 12.07.2023 issued by the Deputy Commissioner, stating that the auction was conducted, and the lands were leased out in a public auction on 21.06.2023. Therefore, learned Assistant Government Pleader requests this Court, by recording the same, the writ petition may be closed. 3 5. By recording the same, the writ petition is closed. No costs. 6.
