1. Heard.
2. By way of this writ petition, the petitioners have prayed for following reliefs:
“10.1. that, the respondent may kindly be directed to submit the entire records as regards the petitioner's case.
10.2. that, this Hon'ble Court may kindly be pleased to quash/amend the advertisement No. 04/2024/Exam/Dated 23/12/2024 of respondent No.3, (Ann.-P/1). Further, the Hon'ble Court directs the respondents to consider and grant relaxation to the petitioner by amending paragraph 3 (iv) (B) of the advertisement (Ann.- P/1) within stipulated time frame, in the interest of justice.
10.3. that, this Hon'ble Court may kindly be pleased to direct the respondents to make correction in the advertisement issued by respondent No. 3, for appointment of upcoming Civil Judge (Junior Division) Exam 2024.
10.4. that, this Hon'ble Court may kindly pass any
order or issue any suitable writ as may deem fit under the circumstances of the case including the cost of the petition.”
3. Learned counsel for the respondent Nos. 2, 3 and 4 have raised an objection that the petition itself is not maintainable as the relief as prayed for by the petitioner is sketchy one, the petitioner is required to challenge the recruitment rules, which can only be
3 challenged before the appropriate forum, which the petitioner has not done.
4. At this juncture, facing the said situation, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to file a duly constituted petition challenging the recruitment rules itself.
5. The liberty as prayed for is granted.
6. With this observation, the petition is hereby dismissed as withdrawn.
