Heard the learned Senior counsel, Sri. Prabhuling K. Navadgi on behalf of Sri. Shashank Nagendran appearing for the petitioner and Sri. Varun P., learned counsel for the respondent.
2. This petition is filed by the petitioner-husband, who has initiated a divorce proceedings under Section 13(1)(ia) of the Hindu Marriage Act, 1955, seeking dissolution of marriage against the respondent-wife.
3. The petition was filed on 01.03.2024 before the learned Family Judge, Bengaluru. The respondent-wife entered appearance. The matter was referred to the Karnataka

NC: 2025:KHC:1407 WP No. 28682 of 2024 Mediation Centre, Bengaluru. Since it was not resolved, the matter was posted before the Court on 30.08.2024, wherein the respondent-wife filed an application to engage a counsel on record to assist her. The matter is now posted for filing of statement of objections/counter to the petition filed by the petitioner-husband. Presently, the matter is posted in the month of March, 2025. The respondent-wife is yet to file statement of objections. Since the matter was not resolved amicably in the Karnataka Mediation Centre, Bengaluru, the present petition is filed for expeditious disposal of the case. There is no serious allegation made against either the Court or the respondent for dragging or protracting the proceedings. Nevertheless, in the matrimonial matters, it is the duty of the Court to see that the matters are disposed off expeditiously. Nevertheless, reasonable opportunity is also required to be granted to the petitioner and the respondent to file their statement of objections to the main as well as any application that would be filed by them. It may be too premature at this stage to contemplate any application that would be filed by either of the parties before the Family Court. Nevertheless, in the interest of both the parties, as this is a matrimonial

NC: 2025:KHC:1407 WP No. 28682 of 2024 proceedings seeking the dissolution of marriage, this Court deems it appropriate that the matter be decided expeditiously.

Learned counsel for the respondent also does not have any objection in the matter being expedited before the learned Family Judge. His concern is that the Family Court should not rush through the proceedings and the respondent- wife be given a reasonable opportunity to file statement of objections and applications, if any.
5. Under these circumstances, I pass the following:
ORDER (i) The petition is allowed. (ii) Learned III Additional Principal Judge, Family Court, Bengaluru is directed to dispose off the matter expeditiously. (iii) Learned III Additional Principal Judge, Family Court, Bengaluru, shall provide reasonable opportunities to both the parties to put forth their pleadings and any other applications that are filed by them, notwithstanding the order of expeditious disposal of the case.
