1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.30/2024 registered at Special Police Station (SOG), District ATS and SOG (Raj.) for the offences punishable under Sections 419, 420, 467, 468 & 471 of IPC and Sections 3, 6, 7 & 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that there is allegation against the petitioner that he sent some other person on his behalf to appear in the examination of Teacher Grade-I. Counsel submits that petitioner was declared as a successful candidate however, it appears that
[2025:RJ-JP:31105] (2 of 2) [CRLMB-656/2025] photograph of the petitioner is not matching with the photograph on the documents. It is contended that there are no criminal antecedents against the petitioner and trial will take considerable time in its conclusion. Counsel submits that petitioner is in custody since his date of arrest and further custody of the petitioner would not serve any fruit purpose. 3. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner and submits that it is a serious offence as petitioner got employment by using unfair means and depriving the rightful person. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, as also looking to the seriousness of the offence, this court is not inclined to enlarge the petitioner on bail. 6. Accordingly, this bail application stands dismissed. 7.
The observations made hereinabove are only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /40
