1.PUBLIC PROSECUTOR The Court made the following order :- A.1, A.2 & A.6 in Crime No.50 of 2024 of Mothugudem police Station, East Godawari District, filed the present application under Section 48O and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking theI'r release On bail. The said crime was registered for the
offence under section. 8(j') read with 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. The case of prosecution is that on o9.07.2024 at about 1.00 P.M., the S.I. of police apprehended A.1 to A.6 near Mothugudem Police Station, who were found in transporting 550 kgs of Ganja in a Eicher truck bearing No.MP 07 GA 2136. After conducting PanChanama and after seizing the contraband, the s.I of police arrested accused, who were remanded to judicial custody.
3. Learned counsel for the petitioners contends that the petitioners were arrested on 09.07.2024 and ever since they are l'n judicial custody. Though the statutory period of 180 days have been completed, the police have not yet filed the charge sheet. As such,
learned counsel for the petitioners requests this court to enlarge the petitioners on bail.
4. On the other hand, learned Additional public Prosecutor, on instructions, confirms the factum of non-filing of the charge sheet within the statutory period of 180 days by the police.
5. This Courtperused the material on record.
6. ln view of the aforesaid facts and circumstances of the case, as the police did not file the charge sheet within the statutory period of 180 days, this Court is inclined to grant bail to the petitioners/A.1, A.2 & A.6, on the followl'ng conditions : - i. The petitioners herein shall be released on baI'l On their executing a personal bond for Rs.50,OOO/- (Rupees fifty thousand only) each with two sureties for a like sum each to
the satisfaction of the learned Judicial Magistrate of First Class, Rampachodavaram ; ii. On release, the petitioners/A.1, A.2 & A.6 shall appear before the Station House Officer, concerned, twice in a week i.e., every Monday and Thursday between 10.00 a.m. to 01.00 p.m., until further orders ; iii. Further, the petitioners are directed to co-operate with the investigation and also the petitioners are directed not to hamper the investigation and tamper with the prosecution witnesses.
