ORAL ORDER The petitioner filed a suit in O.S. No. 783/1995 seeking a permanent injunction, and the jurisdictional Civil Court, by its
judgment and decree dated 05.04.2002, decreed the suit, thereby restraining the defendant-respondent No. 4 herein from interfering with the petitioner’s peaceful possession and enjoyment of the suit schedule property. The decree passed by the Trial Court has attained finality and remains operative against respondent No. 4 as of today.
2. The petitioner’s grievance is that despite the decree, respondent No. 4 is attempting to forcibly dispossess the petitioner from the subject property. The petitioner submitted a representation to respondent No. 1, requesting police protection for the enforcement of the decree, but no action has been taken. Respondents No. 1 to 3 are obligated to provide such protection pursuant to Clause 10 of the Circular dated 14.12.2018.

3. Therefore, it is appropriate to dispose of the petition by directing respondent No. 3 to extend protection to the petitioner on the date on which the petitioner seeks such protection, subject to the petitioner bearing the necessary charges.
