Subba Rao AND ...CONTEMNOR(S) R P Sisodia las and Others Counsel for the Petitioner: 1.RAVI CHANDRA BANDLAMUDI Counsel for the Contemnor(S): 1.NAGARAJU PULLAGURA The Court made the following: ORDER This Contempt Case is filed against the respondents for wilful disobedience of the order, dated 24.11.2023 passed by this Court in W.P.No.32741 of 2022. This Court on 24.11.2023 has passed an order in W.P.No.32741 of 2. 2022, directing the respondents therein to conclude whatever the disciplinary proceedings pending against the petitioner and pass appropriate reasoned order, i within a period of eight (8) weeks from the date of receipt of the a copy of this order. As the said order was not complied with by the respondents, the present Contempt Case is filed. On hearing, learned counsel for the respondents submits that Government after consultation of various advisory departments like Andhra Pradesh Vigilance Commission and the Andhra Pradesh Public Service Commission have concluded disciplinary proceedings instituted against the petitioner imposing penalty of “withholding of entire gratuity vide G.O.Rt.No.34, dated 03.02.2025”. As there is constitutional obligation for consultation of advisory departments like A.P Vigilance Commission and the Andhra Pradesh Public Service Commission and the petitioner has not cooperated with the Department there was delay in concluding disciplinary proceedings. He further submits that the delay caused in implementing the order of this Court is neither willful nor wanton and hence, requests to consider the said delay. 3. 4. Considering the submissions of learned counsel for the respondents, as there is no willful negligence on the part of the respondents in implementing the orders of this Court, dated 24.11.2023 and the respondents have complied with the order of this Court, dated 24.11.2023 in true spirit, in the opinion of this Court, the Contempt Case may be closed. Accordingly, the Contempt Case is closed. However, liberty is given to the petitioner to challenge the proceedings issued by the respondents vide G.O.Rt.No.34, dated 03.02.2025. There shall be no order as to costs. 5. r 6. As a sequel, miscellaneous applications pending, if any, shall stand dismissed.
